These Terms govern your use of labelbid.xyz ("LabelBid", the "Service"). By using LabelBid, submitting a brand, placing a bid or completing a payment, you agree to these Terms and our Privacy Policy.
1. What LabelBid is
LabelBid is a public fashion brand leaderboard. Brands can submit themselves to LabelBid and place bids to obtain a position on the leaderboard. A higher valid bid may result in a higher position. A position on LabelBid is a paid ranking and not an endorsement, review, certification or guarantee of quality.
2. Eligibility
You must be legally capable of entering into a binding agreement. If you use LabelBid on behalf of a company or brand, you confirm that you are authorized to do so.
3. Brand listings
You may only submit a brand, website or social media account that you own or are authorized to represent. You are responsible for the information you submit and must ensure that it is accurate and lawful. LabelBid may request additional information if we need to verify a listing.
4. Bids and rankings
Your bid determines your position according to the ranking system used by LabelBid. Another brand may place a higher bid and move above you. Your position is therefore not guaranteed to remain the same. A payment does not guarantee clicks, visitors, sales, customers, revenue, followers, SEO results or a specific position for a specific period. We may change the ranking system, categories, minimum bids or other features.
5. Payments
Payments are processed through Stripe. The applicable price or bid amount will be shown before you complete payment. Your bank, card issuer or payment provider may charge additional fees or currency conversion costs. Taxes may be added where required.
6. Refunds
Payments are generally final and non-refundable, including when another brand outbids you, your position changes, you receive fewer clicks than expected, you change your mind, or your listing is removed for violating these Terms. Nothing removes mandatory consumer rights. By completing payment, you request that the digital service begins immediately where applicable law permits.
7. Your promises
You confirm that you are authorized to submit the brand, the information is accurate, the listing does not infringe another person’s rights, the website or profile is lawful, you are not impersonating another brand, and the destination is not malware, phishing, fraud or a scam.
8. Prohibited use
You may not use LabelBid for illegal, fraudulent or abusive activities, including impersonation, fraud, malware, phishing, counterfeit products, infringement, illegal regulated services, adult or illegal content, leaderboard manipulation, fake clicks, automated abuse, bypassing security or rate limits, or attacking LabelBid. Detailed rules may be published separately.
9. Removing listings
We may refuse, hide, edit, suspend or remove a listing or ranking if we believe it violates these Terms or Rules, is illegal or fraudulent, infringes third-party rights, contains misleading information, creates a security or legal risk, or creates significant risk to LabelBid or its users. Removal does not automatically create a right to a refund.
10. Public information
Brand names, logos, descriptions, websites, categories, rankings and other listing information may be publicly displayed. By submitting this information, you give LabelBid a worldwide, non-exclusive, royalty-free license to host, display, reproduce and format it as necessary to operate and promote the Service. You confirm that you have the right to provide this content.
11. Third-party websites
LabelBid may link to third-party websites and social media profiles. We are not responsible for their content, products, services, privacy policies, security, transactions or availability. A listing does not mean that LabelBid endorses or guarantees that brand.
12. Availability
We try to keep LabelBid available, but do not guarantee that the Service will always be available, accurate, secure or error-free. We may temporarily suspend or change the Service for maintenance, security, technical or other reasons.
13. Liability
To the maximum extent permitted by law, LabelBid is not responsible for indirect or consequential losses, including lost profits, revenue, customers, data or business opportunities. Total liability relating to a payment is limited to the amount paid for the relevant listing or ranking, unless applicable law requires otherwise.
14. Changes
We may update these Terms or change the Service. When we make material changes, we will update the date at the top of this page. Continued use after an update means you accept the updated Terms where permitted by law.
15. Governing law
These Terms are governed by the laws of the Netherlands, unless mandatory consumer laws in your country provide otherwise. Disputes will be handled by the competent courts, subject to mandatory consumer protection and jurisdiction rules.
16. General
If any part of these Terms is invalid, the remaining provisions remain in effect. These Terms, the Privacy Policy, the Rules and the information shown during checkout form the agreement between you and LabelBid.
